Traffic control is one of the most commonly subcontracted scopes on road-adjacent construction projects. It is also one of the most misunderstood from a liability standpoint.
Many general contractors assume that once they hire a traffic control subcontractor, the risk transfers with the work. It does not. At least not completely.
The GC may still be responsible for maintaining a safe work zone, meeting permit conditions, and correcting visible hazards. If OSHA, DOT, or a local inspector finds a problem, the citation, stop-work order, or delay may land on the GC even if the subcontractor set up the cones, signs, and flaggers.
The Liability Issue GCs Often Miss
Subcontracting traffic control shifts the day-to-day setup to the subcontractor, but it does not erase the GC's responsibility for work zone safety.
Work Zone Safety Is Not Fully Delegable
A GC with control over the work site still has a duty to maintain safe conditions. The traffic control subcontractor can be responsible for its own mistakes, but the GC may also face liability if it failed to vet the subcontractor, review the setup, or correct obvious problems.
In practical terms, if the traffic control plan is wrong, signs are missing, flaggers are absent, or cones are clearly out of position, the GC cannot simply say, "That was the subcontractor's scope."
The Permit Holder Still Has Responsibility
On many public road projects, the GC or owner holds the lane closure, encroachment, or right-of-way permit. That permit includes traffic control requirements.
If the subcontractor's setup does not meet the permit conditions, the inspector usually deals with the permit holder. That can mean fines, correction orders, delayed work, or permit suspension.
This is why the GC should review the permit and confirm that the traffic control plan matches the approved requirements before the subcontractor mobilizes.
OSHA Can Still Cite the GC
On multi-employer work sites, OSHA can cite a controlling employer for hazards created by a subcontractor if the GC knew, or should have known, about the hazard and had the authority to correct it.
Most general contractors meet that controlling-employer definition. Subcontracting traffic control does not remove the GC's supervisory authority or OSHA exposure.
Bottom line: A traffic control subcontractor handles the work, but the GC still needs proper vetting, strong contract terms, and ongoing oversight to manage the risk.
What to Verify Before the Traffic Control Sub Starts
Before a traffic control subcontractor mobilizes, the GC should confirm more than price and availability. These items directly affect compliance, safety, and liability.
ATSSA Certification
Confirm that every flagger and traffic control supervisor assigned to the project has current ATSSA certification or the required state-approved equivalent.
Ask for a certification roster before work begins. Certifications expire, and an expired certification can create the same compliance problem as no certification at all.
Insurance Coverage
Request a certificate of insurance before the subcontractor sets foot on site. At minimum, the sub should carry general liability, workers' compensation, and auto liability coverage appropriate for the project.
Confirm that coverage is active and that your company is listed as an additional insured where required by the subcontract.
Traffic Control Plan and Permit Alignment
The traffic control plan should match the permit conditions. Do not assume the subcontractor has accounted for every requirement.
Before mobilization, review the TCP against the permit. Confirm the plan addresses taper lengths, advance warning signs, device types, work zone limits, flagger positions, officer presence, and any agency-specific requirements.
Jurisdiction Experience
Traffic control rules vary by state DOT, county, city, and road authority. A subcontractor who performs well in one market may not understand another jurisdiction's requirements.
Ask whether the sub has worked with the specific permitting authority on your project. For multi-jurisdiction work, confirm they can coordinate across agencies without delaying the schedule.
Emergency Response Capability
Traffic control problems do not always happen during business hours. If a lane closure needs to change overnight, equipment blocks a travel lane, or an emergency condition develops, you need to know whether the sub can respond.
Ask directly about 24/7 availability, response times, and after-hours coverage before the project starts.
What Belongs in a Traffic Control Subcontract
A traffic control subcontract should do more than list scope and price. It should address the specific compliance and safety risks that come with work zone traffic control.
Compliance Requirements
The subcontract should require compliance with the MUTCD, applicable state DOT standards, OSHA requirements, and all project permit conditions.
Specific standards are stronger than a vague "comply with all laws" clause because they make expectations clearer if a dispute arises.
Certification Requirements
Require all field personnel to hold current ATSSA certification or the applicable state-approved equivalent. The subcontract should also require the sub to provide updated documentation if personnel change during the project.
TCP Review and Approval
The subcontract should require the traffic control plan to be submitted for GC review before mobilization. It should also require approval for any material changes before the field setup is changed.
This prevents the common problem of a subcontractor making field adjustments that no longer match the approved plan or permit conditions.
Daily Documentation
Require daily setup inspections, photos, and documentation. These records matter if there is an OSHA inspection, DOT issue, civil claim, or dispute over whether the work zone was maintained properly.
Indemnification and Insurance
The subcontract should require the traffic control sub to defend and indemnify the GC for claims arising from the sub's negligent work. It should also define insurance limits, additional insured requirements, and incident reporting obligations.
Stop-Work Authority
The GC should have the clear contractual right to stop traffic control operations if the setup is unsafe or non-compliant.
That matters because the GC may have a duty to act when a hazard is visible. The subcontract should support that authority, not leave it open to dispute.

What GC Oversight Should Look Like
Oversight does not mean micromanaging the traffic control subcontractor. It means staying aware of the work zone condition and acting when something is clearly wrong.
What to Watch for on Site
Project managers and superintendents should include traffic control in regular site observations. Obvious issues include:
- Missing or knocked-over advance warning signs
- Cones or drums displaced from the taper line
- Flaggers missing during active work near traffic
- Flaggers without required high-visibility apparel
- A field setup that does not match the TCP
- Work extending beyond the approved work zone
If you see a deficiency, document it and notify the subcontractor in writing. If the issue creates an immediate hazard and is not corrected quickly, stop the affected work until it is fixed.
Permit or Scope Changes
When the work area, schedule, or project scope changes, the traffic control plan may need to change too. The GC should make sure the sub knows about the change and updates the TCP before work continues in the affected area.
After-Hours Coverage
If a lane closure or work zone remains in place overnight, confirm who is responsible for monitoring and maintaining the setup after crews leave.
Traffic control does not stop being important because the shift ended.
Documentation Review
Request and review daily inspection logs at a frequency that fits the project. This creates a record showing the GC was actively monitoring traffic control compliance.
How to Choose the Right Traffic Control Subcontractor
The right traffic control subcontractor makes GC compliance easier. The wrong one creates delays, documentation gaps, field problems, and unnecessary exposure.
Regional Coverage
If your project crosses city, county, or state lines, choose a subcontractor with real experience in those jurisdictions. Multi-state or multi-agency work requires more than crews and cones. It requires permit coordination and local knowledge.
Administrative Capacity
Traffic control creates a lot of paperwork: permits, TCPs, certifications, inspection logs, photos, and closeout records. A capable subcontractor needs the administrative support to manage that documentation.
Honest Communication
A good traffic control sub is honest about what they can handle, where they have experience, how fast they can respond, and what the permitting timeline really looks like.
A subcontractor who says yes to everything and figures it out later can create serious problems once work is live.

Ask for references from similar projects. A company that performs well on small utility work may not be the right fit for a major corridor project, and vice versa.
